21. Once issued, is a patent a done deal?

In the vast majority of cases the answer is yes. However, in a very few instances the validity of an issued patent is challenged in the courts and the patent is subsequently found to be invalid. As this is an exceedingly expensive process, it most frequently occurs in disagreements between corporations. The recently passed America Invents Act also allows others to challenge the validity of a pantent in a post-grant review. A request for the review must be submitted within 9 months after issue.
